The “Litigation” department advises and represents companies and other organisations in their disputes and on insolvency matters, before and after the start of court proceedings,
In particular, the department advises on:
- economic law (competition and anti-competitive restrictive practices, unfair or parasitic competition, pricing practise and sales promotion, etc.),
- commercial law, sales and distribution agreements (breaches of agreements, breakdown of negotiations, unfair termination, non-performance or inadequate performance, non-competition clauses,etc.).
- third party liability law (in particular relating to products of industrial companies),
- intellectual property and new technologies law (breach of copyright, infringement of trademarks, designs and models, rights on domain names, software, etc.),
- commercial leases,
- real estate and construction law,
- insurance policies, and
- criminal business law (white-collar crime).
The department has also developed expertise in insolvency law.
It advises its clients at all stages of the development of the insolvency, namely:
- on the declaration of bankruptcy and during the proceedings, including drafting of the legal documents,
- drafting of transfer plans and continuation plans,
- ownership claims,
- defending actions for debt recovery,
- defending actions for extension of corporate procedure or asset mergers.
